Questioned by Mr. Hewett:-

It used to be a custom to issue written orders, the custom fell into abeyance but has since been revived. 222 Questioned by Attorney-General}

It had been the custom so long as I know for Mr. Fan

Tsung Hing to sign bills beforehand. The two clorks were con

-tinuing the old system which I had given them orders they were

not, to do. The advice of Mr. Messer given in 1909 caused me to

alter the system. I do not suggest that the Colonial Secretary's

Circular No. 37 of 14th. November, 1909, affects the two

clerks. I don't think the two clerks would have seen the

Treasury Circular, they would not necessarily have seen thon. I

did not myself bring them to the clerks' notico. My usual habit

is to endorse to Mr. Chan Pui to circulate to officers concem-

-ed. I cannot say for certain whether I did so in this partinin

particular case.

Questioned by Ur. Fan Tsung Hing:-

I can swear that I gavo orders in November, 1909, not

to sign bills before the money was collected.

I do not admit that the Harbour Master in November,

gave me orders to coase sending receipted bills. I received no

order from the Harbour Master about that time. I received no

communication whatever. I did not admit to the Tarbour Master

and Mr. Lenfestey that I had received these orders.

Harbour Master questioned by Mr. Chan Pui San:-

told Mr. Chan Pul San that part of his letter of

reply to the Colonial Secretary's letter of charge was in- -correct (original draft produced) I told him he had better

alter it. I may have given him the impression that if he did

not alter his letter I would not forward it. For nearly a year

my orders were disobeyed without such coming to my knowledgo.
